Divorce court fees in the UK

Following the recent legal aid reforms there has been a lot written in the press about access to justice & the increase of the divorce court fee.

Divorce, unlike suing someone, is not a ‘choice’.

If you want to legally end a marriage/civil partnership you have to go through the divorce process.

What is rarely reported is that a “Fee Remission Scheme” exists to help with the court fees, for those that qualify.

Divorce Court Fee

To make a divorce application you need to pay a court fee.

The current divorce court fee is £550 (England & Wales).

Legal Aid is not available for divorce applications*.

However, a court fee remission system is available for those individuals on benefits or lower incomes if they meet the income criteria. This scheme helps those people who meet the criteria with the cost of the court fee.

Divorce court fees are part of this remission scheme.

Meaning that you do not have to pay the court fee for your divorce, or that you will receive a reduction in the fee if you are eligible.

You can apply for a court fee remission using Form EX160.

* Legal aid may be available for instances of domestic abuse which is evidenced, and if you meet the criteria.
